1. Agreement to these Terms
By creating an account or otherwise accessing or using VowelMarks, you agree to these Terms. If you do not agree, do not use the Service.
2. What VowelMarks is
VowelMarks provides tools designed to help people read and learn Persian, including reading marks, pronunciation and Pinglish, word information, translation, speech, AI-assisted explanations, guided practice, personalized learning, and related features.
VowelMarks is a reading and learning aid. It is not an authoritative language, legal, medical, financial, or professional translation service.
3. Eligibility and accounts
You must be at least 13 years old to use VowelMarks.
If you create an account, you are responsible for keeping your sign-in credentials secure and for activity under your account. Please contact us if you believe your account has been compromised.
You may not share, sell, or transfer your account in a way that circumvents plan, device, or usage restrictions.
4. Acceptable use and fair use
You may use VowelMarks for lawful personal learning, teaching, reading, and other uses permitted by the Service. Business, integration, or API use is permitted only through features or access that VowelMarks makes available for those purposes.
You may not:
- use the Service unlawfully or to violate another person's rights;
- interfere with, disrupt, damage, or attempt to gain unauthorized access to the Service or another user's account;
- scrape, crawl, bulk-extract, or automate use of the Service except where VowelMarks expressly permits it;
- evade or attempt to evade plan limits, rate limits, device restrictions, security measures, or other service safeguards;
- reverse-engineer or attempt to extract non-public source code or underlying systems except to the extent applicable law expressly permits it; or
- resell, sublicense, or provide access to the Service or its capacity as a competing service unless VowelMarks expressly authorizes that use.
Where a VowelMarks feature is described as “Unlimited,” that means ordinary use consistent with the intended purpose of the feature. Unlimited features may remain subject to reasonable fair-use, rate, capacity, security, and abuse-prevention safeguards. Current plan allowances and applicable safeguards are described on the Pricing page.
We may restrict or suspend activity that violates these Terms or materially interferes with the Service or its availability to other users.
5. Developer and API access
Developer API access is private and manually reviewed. If you use the API for a business or other organization, you represent that you have authority to agree to these Terms for that organization, and the organization is responsible for its members, integrations, API keys, and use of the Service.
API keys are confidential server-side credentials. You must not place them in browser code, downloadable client software, public repositories, URLs, logs, or analytics. You must promptly revoke a key that may have been exposed.
API plans, included usage, rate limits, endpoint behavior, data handling, and other operational rules are described on the API page and in theDeveloper API documentation. Allowances are shared as described in those materials, and additional usage is enabled only after confirmation. Unless VowelMarks agrees otherwise in writing, Developer API access does not include a service-level agreement.
6. Generated results and AI-assisted features
VowelMarks makes automated judgments about language. Results may be inaccurate, incomplete, or inappropriate for a particular context. Persian may have multiple valid readings, and errors can occur in diacritization, pronunciation, Pinglish, word origins, translation, speech, explanations, AI responses, practice material, grading, personalization, and other generated results.
You are responsible for evaluating VowelMarks output before relying on it. Do not rely on the Service where an incorrect result could cause significant harm, including for legal, medical, financial, safety-critical, or other high-stakes decisions.
Some features rely on third-party AI, translation, speech, or other processing services. Our Privacy Policy explains what information may be sent to service providers and how VowelMarks handles your information.
7. Plans, subscriptions, cancellation, and refunds
VowelMarks may offer Free, Pro, or other plans with different features and usage allowances. Current plan details and prices are shown on our Pricing page and during checkout.
Paid subscriptions automatically renew at the applicable billing interval until canceled. You can cancel future renewal using the billing controls available through your account or our merchant-of-record payment provider. Unless otherwise stated, cancellation stops future renewal and your paid access continues through the period already paid for.
Subscription payments and refunds are governed by our Refund Policy and any non-waivable rights provided by applicable law. Our merchant-of-record payment provider may also process refunds, reversals, or other billing adjustments where required.
We may change prices, plan features, or usage allowances for future billing periods. A material reduction to the core benefits or allowances of a prepaid paid plan will not normally take effect before the end of the current paid period, except where an earlier change is reasonably necessary for security, abuse prevention, legal compliance, or because a third-party service needed to provide the feature becomes unavailable. We will provide notice of material changes where required by applicable law.
8. Your content
You retain whatever rights you have in text, recordings, feedback, or other content you submit to VowelMarks.
By submitting content to the Service, you give VowelMarks a limited, non-exclusive right to process, reproduce, transmit, and store that content as reasonably necessary to provide, operate, secure, and support the features you use. This includes allowing our service providers to process content where needed to provide a requested feature.
You are responsible for ensuring that your use of content through VowelMarks is lawful and does not violate another person's rights. VowelMarks does not claim ownership of your submitted content.
Our Privacy Policy explains how submitted content and learning information are handled.
9. VowelMarks software and intellectual property
Except for third-party materials governed by their own licenses, VowelMarks and our original software, interfaces, design, branding, documentation, and other materials are owned by us or our licensors and are protected by applicable intellectual-property laws.
Subject to these Terms, VowelMarks gives you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Service for its intended purposes. This does not transfer ownership of VowelMarks software or intellectual property to you.
If you voluntarily provide suggestions or ideas about VowelMarks, we may use them to develop or improve the Service without an obligation to compensate you.
10. Privacy
Our Privacy Policy explains how VowelMarks collects, uses, stores, and shares information when you use the Service.
11. Service changes, suspension, and termination
VowelMarks may add, change, limit, suspend, or discontinue features or portions of the Service. Changes to the pricing, core benefits, or usage allowances of paid plans are subject to Section 7.
You may stop using VowelMarks at any time.
We may suspend or terminate access when reasonably necessary because of a violation of these Terms, non-payment, fraud, abuse, security concerns, legal requirements, or conduct that threatens the Service or other users.
If we discontinue a paid portion of the Service, any applicable refund or credit will be handled in accordance with our Refund Policy, our merchant-of-record provider's requirements, and applicable law.
Termination or suspension resulting from your violation of these Terms does not create a right to a refund except where our Refund Policy or applicable law provides otherwise.
Sections that by their nature should continue after termination, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, and disputes, will continue to apply.
12. Disclaimers
To the fullest extent permitted by law, VowelMarks and the Service are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.
We disclaim warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted availability.
We do not guarantee that VowelMarks will always be available, error-free, secure, or compatible with every website, browser, device, language variety, or third-party service, or that saved content or learning information will never be lost or altered.
Nothing in these Terms excludes a warranty or right that applicable law does not allow to be excluded.
13. Limitation of liability
To the fullest extent permitted by law, VowelMarks will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, opportunities, anticipated savings, goodwill, or data arising out of or relating to the Service.
To the fullest extent permitted by law, VowelMarks will also not be liable for losses arising from your reliance on diacritization, pronunciation, Pinglish, word-origin information, translations, speech, AI responses, explanations, practice results, grading, personalization, or other generated output; loss or corruption of saved content or learning information; interruptions or unavailability of the Service; or failures of third-party services on which VowelMarks depends.
To the fullest extent permitted by law, VowelMarks's total aggregate liability arising out of or relating to the Service will not exceed the amount you paid for the Service during the 12 months immediately preceding the event giving rise to the claim.
These exclusions and limitations apply regardless of the legal theory on which a claim is based and even if VowelMarks has been advised that a loss was possible.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded. Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the limitations above may not apply to you.
14. Indemnification for business, integration, and API use
If you use VowelMarks on behalf of a business or organization, integrate VowelMarks into another product or service, or use an API or other developer offering that we make available, you agree, to the extent permitted by law, to indemnify and hold VowelMarks harmless from third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from your unlawful use of the Service, your violation of these Terms, or content you submit or make available through your integration that infringes or violates another person's rights.
This obligation does not apply to the extent a claim results from VowelMarks's own conduct for which liability cannot lawfully be excluded.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Any dispute that cannot be resolved informally will be handled in a state or federal court of competent jurisdiction located in California. You and VowelMarks consent to the jurisdiction of those courts, subject to any rights that applicable law does not allow these Terms to waive.
16. Changes to these Terms
We may update these Terms as VowelMarks changes. When we do, we will update the “Last updated” date.
If a change materially affects your rights or obligations, we may provide additional notice where appropriate or required by law. Your continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.
17. General provisions
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
VowelMarks is not responsible for delays or failures caused by circumstances outside our reasonable control, including failures of third-party infrastructure or service providers.
We may assign or transfer these Terms in connection with a reorganization, financing, sale of the business, transfer of assets, or similar transaction. You may not assign your rights under these Terms without our consent.
These Terms, together with any additional terms or policies expressly referenced for a particular VowelMarks feature or transaction, govern your use of the Service.
